Purpose
These terms govern the use of the MotivMe service, whether the landing site motivme.app or the mobile app. By browsing the site or creating an account in the app, you accept these terms. The terms of the paid Inferno subscription are set out in our terms of sale.
User account
Using the app requires creating an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for activity carried out from your account. An account is strictly personal. You must meet the minimum age stated in our privacy policy.
Access and availability
The site is freely accessible to any user with an Internet connection. The app is available on iOS and Android; the costs required for access (hardware, connection, store) are your responsibility. We strive to keep the service running but do not guarantee uninterrupted availability: we may modify, suspend, or discontinue all or part of the service, in particular for maintenance.
Inferno subscription
MotivMe offers a free plan and a paid subscription, Inferno, which unlocks additional features. The subscription, pricing, renewal, and cancellation of this plan are governed by our terms of sale.
Your content
The content you create in the app (objectives, routines, tasks, focus sessions, journal entries) remains yours. You grant us only the technical rights needed to host, back up, and sync this content in order to provide the service. You are responsible for the lawfulness of the content you store.
Acceptable use
When using MotivMe, you agree not to:
- use the service for unlawful purposes or in breach of these terms;
- attempt to access without authorization the systems, accounts, or data of others;
- disrupt the operation of the service or circumvent its security measures;
- decompile, disassemble, or reverse engineer the app, except as permitted by law.
Intellectual property
All elements of the service (text, visuals, interface, the MotivMe name and logo, the Ember mascot) are protected by intellectual property law and remain our property or that of our partners. Any reproduction, even partial, is prohibited without prior written authorization. This protection does not extend to your content, which remains yours.
Limitation of liability
MotivMe is a productivity and wellbeing tool. It does not constitute medical, psychological, or professional advice, and does not replace the advice of a qualified person. The service is provided "as is". To the extent permitted by law, we cannot be held liable for indirect damages resulting from the use of, or inability to use, the service. Nothing in these terms limits liability that cannot be limited under applicable law, in particular towards consumers.
Termination
You may stop using the service and delete your account at any time [TO CONFIRM: from the app and/or by request to our support]. Deleting your account results in the deletion of your data as described in the privacy policy. We may suspend or terminate your access in the event of a serious breach of these terms.
External links
The service may contain links to third-party sites or services. We assume no responsibility for the content of those sites.
Changes to these terms
We may update these terms. In the event of a material change, we will inform you (by email or in the app). The date of the latest update appears at the top of this page; by continuing to use the service, you accept the updated terms.
Governing law
These terms are governed by Belgian law. In the event of a dispute, and failing an amicable settlement, the Belgian courts have jurisdiction, without prejudice to the mandatory rules protecting consumers.
As a consumer, you may also use the free Consumer Mediation Service (Boulevard du Roi Albert II 8 box 1, 1000 Brussels, Belgium).
